Please read these Terms and Conditions ("Terms", "T&Cs") carefully before using the FlowerFreedom mobile application (the "App") operated by an individual publisher based in the United Kingdom (referred to as "I", "me", "the Publisher").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users, visitors, and others who access or use the App.
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use the App.
UK Only Service: FlowerFreedom is currently only available to users in the United Kingdom. By using this App, you confirm that you are located in the UK.
1. About FlowerFreedom
1.1 What FlowerFreedom Is
FlowerFreedom is an iOS mobile application designed to provide accountability coaching and support for personal development goals. The App offers:
- AI-powered conversational coaching tailored to your personal journey
- Daily check-in tracking and progress monitoring
- Personalised motivational notifications
- Crisis detection and supportive resources
- Progress visualisation including streaks and savings tracking
- Customisable coaching tone and style
- Biometric security features (Face ID/Touch ID)
1.2 Individual Publisher
FlowerFreedom is published and operated by me, an individual based in the United Kingdom, not a limited company or corporation. This means:
- I am personally responsible for the App's operation and your user experience
- Support is provided directly by me
- These Terms reflect individual operation rather than corporate structure

2. Medical Disclaimer and Limitations
2.1 Not Medical Advice or Healthcare
FlowerFreedom is NOT a healthcare provider, medical service, mental health service, or therapy app. The App does not provide:
- Medical, psychological, or psychiatric advice, diagnosis, or treatment
- Professional mental health counselling or therapy
- Crisis intervention or emergency services
- Addiction treatment or clinical support
- Substitute for professional healthcare of any kind
2.2 AI-Generated Content Limitations
All coaching responses in FlowerFreedom are generated by Artificial Intelligence (AI) technology. You acknowledge and agree that:
- AI Is Not a Professional: AI coaching is not a substitute for advice from qualified healthcare professionals, therapists, counsellors, or medical practitioners
- AI Can Make Mistakes: AI-generated responses may occasionally be inaccurate, inappropriate, or not suited to your specific situation
- No Diagnosis or Treatment: AI responses do not constitute medical diagnosis, mental health assessment, or treatment recommendations
- General Information Only: All AI coaching is for informational and motivational purposes only
2.3 Emergency and Crisis Situations
IF YOU ARE EXPERIENCING A MEDICAL OR MENTAL HEALTH EMERGENCY, OR ARE IN CRISIS:
- Call 999 immediately for life-threatening emergencies
- Call 111 for urgent medical help when it's not life-threatening
- Contact Samaritans on 116 123 (free 24/7) for emotional support
- Text "SHOUT" to 85258 to contact the Shout Crisis Text Line
- Contact your GP or local mental health crisis team
- Go to A&E if you feel you cannot keep yourself safe
DO NOT rely on FlowerFreedom for crisis intervention, emergency assistance, or urgent mental health support. While the App includes crisis detection features that may provide supportive resources, these are NOT a substitute for professional emergency services.
2.4 Your Responsibility
By using FlowerFreedom, you acknowledge and agree that:
- You are solely responsible for your use of the App and the decisions you make
- You will seek appropriate professional help for medical, mental health, or crisis concerns
- You will not use the App as a replacement for professional healthcare
- You understand the AI coaching is for general motivational support only
- I am not liable for any consequences arising from your reliance on App content
2.5 When to Seek Professional Help
You should consult a qualified healthcare professional if you experience:
- Thoughts of self-harm or suicide
- Severe depression, anxiety, or other mental health symptoms
- Addiction or substance abuse issues requiring clinical intervention
- Physical health concerns related to your goals
- Any situation where you need professional medical or psychological support
3. Eligibility and User Accounts
3.1 Age Requirement
FlowerFreedom is intended for users aged 18 years or older. By using the App, you represent and warrant that you are at least 18 years of age. If you are under 18, you must not use FlowerFreedom.
If I discover that someone under 18 has created an account, I will immediately delete that account and all associated data.
3.2 Account Registration
To use FlowerFreedom, you must:
- Create an account using a valid email address
- Provide accurate and complete information
- Keep your account credentials secure and confidential
- Notify me immediately of any unauthorised use of your account
3.3 Account Security
You are responsible for:
- Maintaining the security of your account and password
- All activities that occur under your account
- Ensuring your device security, especially if using biometric authentication
4. Subscriptions and Payments
4.1 Free and Premium Tiers
FlowerFreedom offers both free and premium subscription options:
- Free Tier: Basic access to core accountability features
- Premium Subscription ("Pro"): Unlimited access to all features, including advanced AI coaching and analytics
4.2 Subscription Terms
Premium subscriptions are managed through Apple's App Store and RevenueCat. By subscribing, you agree that:
- Subscriptions are billed through your Apple ID account
- Payment is charged to your Apple ID at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage or cancel subscriptions in your Apple ID account settings
4.3 Pricing and Changes
Subscription prices are displayed in the App and are subject to change. Price changes will:
- Be communicated to existing subscribers in advance
- Apply from your next renewal date
- Give you the option to cancel before the new price takes effect
4.4 Refunds and Cancellations
Refund policies follow Apple's App Store guidelines. Generally:
- All sales are final and non-refundable unless required by law
- You may cancel your subscription at any time (cancellation takes effect at the end of the current billing period)
- No partial refunds are provided for unused portions of subscription periods
- For refund requests, contact Apple Support directly through the App Store
4.5 Consumer Rights
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer protection laws. You have the right to:
- Receive digital content that is of satisfactory quality, fit for purpose, and as described
- Request a repair or replacement if the digital content is faulty
- Request a price reduction or the contract to end and receive a refund in certain circumstances
5. User Conduct and Prohibited Uses
5.1 Acceptable Use
You agree to use FlowerFreedom only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App in any way that violates any applicable UK or international law or regulation
- Exploit, harm, or attempt to exploit or harm minors in any way
- Transmit any advertising, promotional material, "junk mail", "spam", "chain letters", or similar solicitations
- Attempt to gain unauthorised access to the App, servers, or networks
- Interfere with or disrupt the App or servers
- Use automated systems (bots, scripts) to access the App without permission
- Reverse engineer, decompile, or attempt to extract source code from the App
- Use the App to harass, abuse, threaten, or otherwise violate the rights of others
5.2 Content Restrictions
When using the AI coaching chat feature, you must not submit content that:
- Is illegal, defamatory, hateful, or discriminatory
- Promotes violence, terrorism, or harm to others
- Infringes intellectual property rights
- Contains malware, viruses, or other harmful code
- Attempts to abuse or exploit the AI system
6. User-Generated Content
6.1 Your Content
You retain ownership of all content you submit through the App, including:
- Chat messages and conversations with the AI coach
- Profile information (motivations, triggers, fears, notes)
- Daily check-in data and progress tracking information
6.2 Licence to Publisher
By submitting content to FlowerFreedom, you grant me a limited, worldwide, non-exclusive, royalty-free licence to:
- Use, process, and analyse your content to provide the App's services
- Generate AI coaching responses based on your messages and profile
- Improve the App's crisis detection and personalisation features
- Store your content as necessary to provide App functionality
This licence exists solely to operate and improve FlowerFreedom's services as described in the Privacy Policy. I do not sell your content or use it for advertising purposes.
6.3 Third-Party AI Service
FlowerFreedom uses a third-party AI service provider to generate coaching responses. Your chat messages are:
- Automatically redacted of personal information (phone numbers, emails, addresses) before transmission
- Shared with the AI service provider to generate responses
- Retained by the AI provider for up to 30 days for trust and safety monitoring (abuse detection)
- Never used to train AI models or improve the provider's products
- Processed through automated content classifiers (no human review)
This data sharing is necessary to provide the AI coaching service and complies with industry-standard practices.
6.4 Content Responsibility
You are solely responsible for the content you submit and the consequences of posting it. I am not responsible for monitoring or removing user content, though I reserve the right to remove any content that violates these Terms.
7. Privacy and Data Protection
7.1 Privacy Policy
Your use of FlowerFreedom is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data. The Privacy Policy is available at: flowerfreedom.com/privacy
7.2 Data Controller
As an individual publisher based in the UK, I am the data controller for your personal information. I comply with UK data protection laws, including the UK GDPR and Data Protection Act 2018.
7.3 Your Data Rights
You have the right to:
- Access your personal data
- Correct inaccurate data
- Delete your account and all associated data
- Export your data
- Withdraw consent for data processing
- Lodge a complaint with the Information Commissioner's Office (ICO)

8. Intellectual Property Rights
8.1 Publisher's Rights
The App and all its contents, features, and functionality (including but not limited to software, text, displays, images, graphics, design, and the selection and arrangement thereof) are owned by me, my licensors, or other providers of such material. They are protected by UK and international copyright, trademark, patent, trade secret, and other intellectual property laws.
8.2 Limited Licence to Use
I grant you a limited, non-exclusive, non-transferable, revocable licence to:
- Download and install the App on your personal iOS device
- Use the App strictly in accordance with these Terms
- Access the App's features for your personal, non-commercial use
8.3 Restrictions
You must NOT:
- Copy, modify, distribute, or create derivative works based on the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Use the App's intellectual property for commercial purposes
- Transfer, sublicense, or resell your licence to use the App
9. Service Availability and Changes
9.1 Service Availability
While I strive to provide reliable access to FlowerFreedom, I do not guarantee that:
- The App will be available at all times or without interruption
- The App will be free from errors, bugs, or security vulnerabilities
- Defects will be corrected within a specific timeframe
- The App will be compatible with all devices or iOS versions
9.2 Maintenance and Updates
I may:
- Perform scheduled or emergency maintenance that temporarily interrupts service
- Release updates, patches, or new versions of the App
- Require you to download updates to continue using the App
9.3 Changes to Features
I reserve the right to:
- Modify, suspend, or discontinue any feature of the App at any time
- Change how the App works or how features are delivered
- Add or remove features without prior notice (subject to consumer rights)
If material changes affect paid subscribers, I will make reasonable efforts to notify you in advance.
10. Third-Party Services
10.1 Third-Party Integrations
FlowerFreedom integrates with third-party services including:
- Firebase (Google): User authentication and push notifications
- AI Service Provider: Conversational AI coaching responses
- RevenueCat: Subscription management and payments
- Apple Services: App Store, In-App Purchases, biometric authentication
10.2 Third-Party Terms
Your use of these third-party services is subject to their respective terms and privacy policies. I am not responsible for:
- The availability, accuracy, or content of third-party services
- Third-party privacy practices (see Privacy Policy for details)
- Changes or interruptions to third-party services
- Any liability arising from your use of third-party services
11. Disclaimers and Warranties
11.1 "As Is" Provision
FlowerFreedom is provided on an "AS IS" and "AS AVAILABLE" basis. I make no warranties or representations about:
- The accuracy, reliability, or completeness of AI-generated coaching content
- The suitability of the App for your specific goals or circumstances
- The effectiveness of the App in helping you achieve your objectives
- Uninterrupted or error-free operation of the App
11.2 No Warranty
To the fullest extent permitted by law, I disclaim all warranties, express or implied, including:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the App will meet your requirements or expectations
- Warranties that results obtained from using the App will be accurate or reliable
11.3 Consumer Rights Not Affected
Nothing in this section affects your statutory rights under UK consumer protection laws, including the Consumer Rights Act 2015. You have legal rights in relation to digital content that is faulty or not as described.
12. Limitation of Liability
12.1 Scope of Limitation
To the fullest extent permitted by law, I shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App
- Loss of profits, data, goodwill, or other intangible losses
- Damages resulting from:
- Your reliance on AI-generated coaching content
- Unauthorised access to or alteration of your data
- Actions or content of third parties using the App
- Service interruptions, errors, or bugs
12.2 Maximum Liability
My total liability to you for all claims arising from your use of FlowerFreedom shall not exceed:
- For free users: £50 (fifty pounds)
- For premium subscribers: The total amount you paid for your subscription in the 12 months preceding the claim
12.3 Exceptions
Nothing in these Terms excludes or limits my liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under UK law
12.4 Basis of Bargain
You acknowledge that I have made the App available to you in reliance upon these liability limitations and disclaimers, which reflect a reasonable allocation of risk.
13. Indemnification
You agree to defend, indemnify, and hold me harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising from or relating to:
- Your violation of these Terms
- Your use or misuse of the App
- Your content or submissions to the App
- Your violation of any third-party rights, including intellectual property rights
- Your violation of applicable laws or regulations
I reserve the right to assume exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with my defence of such claim.
14. Termination
14.1 Termination by You
You may terminate your use of FlowerFreedom at any time by:
- Deleting your account through the App settings
- Uninstalling the App from your device
- Cancelling any active subscriptions
Account deletion is immediate and permanent. All your data will be deleted and cannot be recovered.
14.2 Termination by Publisher
I may suspend or terminate your access to the App immediately, without prior notice or liability, if:
- You breach these Terms
- You engage in fraudulent or illegal activity
- You abuse or misuse the App
- I am required to do so by law
- I decide to discontinue the App
14.3 Effect of Termination
Upon termination:
- Your right to use the App immediately ceases
- Your account and data may be deleted
- Active subscriptions may be cancelled (refund policies apply)
- Provisions that by their nature should survive termination will remain in effect (including liability limitations, indemnification, and governing law)
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute with FlowerFreedom, please contact me first at support@flowerfreedom.com. I will make reasonable efforts to resolve disputes amicably.
15.2 Alternative Dispute Resolution
If we cannot resolve a dispute informally, you may use alternative dispute resolution services such as:
- The Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr
- Mediation or arbitration services
16. Governing Law and Jurisdiction
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Scotland, without regard to conflict of law principles.
16.2 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts of Scotland to resolve any legal matter arising from these Terms or your use of FlowerFreedom.
16.3 Consumer Rights
If you are a consumer resident in the UK, nothing in this clause affects your rights to bring proceedings in your local courts or under applicable consumer protection laws.
17. General Provisions
17.1 Changes to Terms
I reserve the right to modify these Terms at any time. When changes are made:
- The "Last Updated" date will be revised
- You will be notified via in-app alert for material changes
- Continued use of the App after changes constitutes acceptance of the new Terms
- If you don't agree with changes, you must stop using the App and may delete your account
17.2 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding FlowerFreedom and supersede all prior agreements or understandings.
17.3 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall remain in full force and effect.
17.4 Waiver
My failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by me.
17.5 Assignment
You may not assign or transfer these Terms or your rights under them without my prior written consent. I may assign these Terms without restriction.
17.6 No Partnership
Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and me.
17.7 Force Majeure
I shall not be liable for any failure or delay in performance due to circumstances beyond my reasonable control, including acts of God, war, terrorism, riots, pandemic, internet or telecommunications failures, or acts of government.
